Terms of Service (“Agreement”)

Please read these Terms of Service (“Agreement”) carefully before using flowfinleads.com (the “Site”), owned and operated by FlowFinLeads (“FlowFinLeads,” “we,” “us,” or “our”).By accessing or using the Site or purchasing leads or services from FlowFinLeads (the “Service”), you agree to be bound by this Agreement. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Services

FlowFinLeads provide marketing and lead delivery services to licensed financial professionals.

FlowFinLeads:

Generates and delivers consumer inquiries (“Leads”)

Does not sell insurance policies

Does not provide financial advice or recommendations

Does not participate in sales, quoting, underwriting, or policy issuance

All Leads are generated through third-party advertising, landing pages, or data collection methods and are delivered to Clients for their own independent follow-up.

2. Eligibility & User Obligations

By using the Service, you represent and warrant that you:

Are at least 18 years of age

Are a licensed financial agent or authorized business entity

Are legally permitted to solicit, market, and sell financial products in your operating jurisdictions

Will use the Leads only for lawful business purposes

You agree to:

Provide accurate and complete account information

Maintain the confidentiality of your login credentials

Use Leads only in compliance with applicable laws

Not resell, redistribute, scrape, or misuse Leads

Not reverse engineer or interfere with the Service

3. Licensing & Regulatory Compliance

You are solely responsible for maintaining all required licenses, appointments, certifications, and regulatory compliance in every jurisdiction where you operate.

FlowFinLeads does not:

Verify license status on an ongoing basis

Monitor agent compliance

Act as a financial agency or broker

We reserve the right to request proof of licensure and to suspend or terminate access for non-compliance.

4. Lead Delivery, No Performance Guarantees & Replacement

FlowFinLeads does not guarantee:

Sales, commissions, or revenue

Conversion rates or contact rates

Policy placement or underwriting approval

Leads are delivered based on availability, targeting criteria, and campaign performance. All Leads are provided “as is.”

We replace all leads no questions asked if they are:

Non‑working or disconnected number at time of delivery.

Clearly fake identity (e.g., obvious profanity or nonsense in required fields).

Duplicate Lead previously delivered to the same Client within a defined period.

5. Consumer Consent & Communications

FlowFinLeads represents that Leads are generated from consumers who have provided consent to be contacted by insurance professionals.

Prior express written consent (for automated dialers/texts) where required.​

Consent that clearly names or identifies the specific business (or category of sellers) that may contact the consumer, consistent with evolving “1:1 consent” standards.

However:

You are solely responsible for TCPA, CASL, CAN-SPAM, and state telemarketing compliance

You determine how and when consumers are contacted

You bear all legal responsibility for your communications

FlowFinLeads is not liable for fines, penalties, or regulatory actions arising from your outreach practices.

6. No Financial, Legal, or Insurance Advice

FlowFinLeads does not provide:

Financial advice

Legal advice

Insurance advice

Tax advice

All information provided is for marketing and informational purposes only. You are responsible for consulting qualified professionals as needed.

7. Third-Party Services

The Service may integrate with or rely on third-party platforms (CRMs, SMS providers, ad platforms, etc.).

FlowFinLeads is not responsible for:

Downtime or errors caused by third parties

Data handling outside our systems

Third-party terms, pricing, or compliance

Any agreements with third parties are solely between you and that provider.

8. Intellectual Property

All content, branding, systems, processes, and materials on the Site are the exclusive property of FlowFinLeads and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without written permission.

9. Limitation of Liability

To the fullest extent permitted by law, FlowFinLeads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost revenue.

In no event shall FlowFinLeads’ total liability exceed the amount paid by you for the specific Lead or service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless FlowFinLeads, its owners, employees, contractors, and affiliates from any claims, damages, losses, fines, penalties, legal actions, or expenses (including attorney fees) arising from:

Your use of the Service

Your communications with Leads

Your failure to comply with licensing or regulatory requirements

Any financial-related representations or sales activities

11. Termination

FlowFinLeads reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
