Terms of Service ("Agreement")

Please read these Terms of Service ("Agreement") carefully before using flowfinleads.com (the "Site"), owned and operated by Flowfinleads ("Flowfinleads," "we," "us," or "our"). By accessing or using the Site or purchasing leads or services from Flowfinleads (the "Service"), you agree to be bound by this Agreement. If you do not agree to these Terms, you may not access or use the Service.
1. Description of Services
Flowfinleads is a B2B lead distribution platform that connects financial services businesses with consumer leads generated through our affiliated marketing channels and consumer-facing platforms.
Flowfinleads:
Generates and delivers consumer inquiries ("Leads") to verified financial services businesses ("Clients").
Operates across multiple financial verticals including, but not limited to, business loans, insurance, and wealth management.
Does not provide loans, insurance products, investment advice, or any direct financial services.
Does not make lending, underwriting, or coverage decisions.
Does not provide legal, financial, tax, or regulatory compliance advice.
Does not participate in client negotiations, deal closings, or service delivery between Clients and end consumers.
All Leads are generated through third-party advertising, landing pages, or affiliated data collection methods and are delivered to Clients for their own independent follow-up.
2. Eligibility & Client Obligations
By using the Service, you represent and warrant that you:
Are at least 18 years of age and are authorized to enter into this Agreement on behalf of your business.
Are a legally registered business entity operating in the financial services industry (including lending, brokering, insurance, wealth management, or related fields).
Hold all required licenses, registrations, and regulatory approvals necessary to operate in your jurisdiction and vertical.
Are legally permitted to solicit, market, and sell financial products or services to consumers in your operating jurisdictions.
Will use Leads only for lawful business purposes consistent with your licensed activities.
You agree to:
Provide accurate and complete account and business information.
Maintain the confidentiality of your login credentials.
Use Leads only in compliance with all applicable federal, provincial, state, and local laws.
Not resell, redistribute, scrape, sublicense, or otherwise transfer Leads to unauthorized third parties.
Not reverse engineer, copy, or interfere with the Service or platform infrastructure.
3. Licensing & Regulatory Compliance
You are solely responsible for maintaining all required licenses, registrations, certifications, and regulatory compliance in every jurisdiction and vertical in which you operate, including but not limited to:
Applicable lending and brokerage licensing requirements.
Insurance producer or broker licensing where applicable.
Investment adviser or wealth management registrations where applicable.
All applicable consumer protection, financial services, and data privacy regulations.
Flowfinleads does not:
Verify license status on an ongoing basis.
Monitor Client regulatory compliance.
Act as a lender, broker, insurer, or financial adviser.
We reserve the right to request proof of licensure at any time and to suspend or terminate access for non-compliance.
4. Lead Delivery, Quality & Replacement
Flowfinleads does not guarantee:
Conversion rates, contact rates, or closed deals.
Revenue, profit, or return on investment.
A specific volume of Leads at any given time.
Leads are delivered based on availability, targeting criteria, vertical, and campaign performance. All Leads are provided "as is."
We will replace Leads at no charge if they meet any of the following criteria:
Non-working or disconnected phone number at the time of delivery.
Clearly fraudulent or fake submission (e.g., obvious nonsense or profanity in required fields).
Duplicate Lead previously delivered to the same Client within a defined period.
Replacement requests must be submitted within the timeframe specified in your applicable order or service agreement. Leads that do not convert or do not meet your internal quality standards outside of the above criteria are not eligible for replacement.
5. Consumer Consent & Communications Compliance
Flowfinleads represents that Leads are generated from consumers who have provided consent to be contacted by financial services providers at the point of data collection, including:
Prior express written consent where required by applicable law.
Consent that identifies the category of financial services providers that may contact the consumer.
However, you as the Client are solely responsible for:
Your own compliance with TCPA, CASL, CAN-SPAM, and all applicable federal, provincial, and state telemarketing, communications, and privacy laws.
Determining how, when, and through what channels consumers are contacted.
Maintaining your own records of consent where required by law.
All legal liability arising from your outreach practices.
Flowfinleads is not liable for fines, penalties, regulatory actions, or legal claims arising from your communications with Leads.
6. No Financial, Legal, or Professional Advice
Flowfinleads does not provide:
Financial or investment advice.
Legal or compliance advice.
Tax advice.
Insurance guidance or recommendations.
Underwriting or risk assessment services.
All information provided through the Service is for marketing and operational purposes only. You are responsible for consulting qualified professionals regarding your own compliance, licensing, and business obligations.
7. Payments & Billing
Lead pricing, billing frequency, and payment terms will be specified in your applicable order, proposal, or service agreement with Flowfinleads.
You agree to:
Pay all fees in accordance with your agreed payment terms.
Maintain valid and current payment information on file.
Notify us promptly of any billing disputes within the timeframe specified in your service agreement.
Flowfinleads reserves the right to suspend Lead delivery for overdue accounts. All fees are non-refundable except as expressly stated in our Lead replacement policy above or your applicable service agreement.
8. Third-Party Services
The Service may integrate with or rely on third-party platforms including CRMs, SMS providers, advertising platforms, and payment processors.
Flowfinleads is not responsible for:
Downtime or errors caused by third-party platforms.
Data handling outside our systems.
Third-party terms, pricing, or compliance obligations.
Any agreements with third-party providers are solely between you and that provider.
9. Intellectual Property
All content, branding, systems, processes, and materials on the Site are the exclusive property of Flowfinleads and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, or exploit any content without prior written permission from Flowfinleads.
10. Confidentiality
By accessing the Service, you may receive access to non-public information regarding our platform, pricing, lead sources, and operational methods ("Confidential Information"). You agree to:
Keep all Confidential Information strictly confidential.
Not disclose Confidential Information to any third party without prior written consent.
Use Confidential Information solely for the purpose of using the Service.
This obligation survives termination of this Agreement.
11. Limitation of Liability
To the fullest extent permitted by law, Flowfinleads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or business losses arising from your use of the Service or any Leads delivered.
In no event shall Flowfinleads' total liability exceed the amount paid by you for the specific Leads or services giving rise to the claim in the thirty (30) days preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Flowfinleads, its owners, employees, contractors, and affiliates from any claims, damages, losses, fines, penalties, legal actions, or expenses, including attorney fees, arising from:
Your use of the Service or any Leads delivered.
Your communications with end consumers.
Your failure to maintain required licenses or regulatory compliance.
Any financial products, services, or representations made to consumers.
Your violation of these Terms or applicable law.
13. Termination
Flowfinleads reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms or failure to maintain required licensure.
Upon termination, all outstanding payment obligations remain due and payable. Sections 5, 6, 9, 10, 11, 12, and 14 survive termination.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict-of-law principles.
15. Changes to These Terms
We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
